I was wondering about this because I was in Florida and saw a car wreck, and a person was using their phone with the camera going at the same time, I was wondering if its against the law to be using a cell phone when you are driving or not?

In Florida it is against the law to not have the phone on in your ear during any time that you are driving. I think it is in every state now, and there are fines for not having it on (obviously…not just the fines, but having it off during that time period is against the law).

I’m in New York state, but haven’t seen anything like that here. But I have read stories about people being pulled over and the officer stating that cell phones are distracting for the driver, and that police should be able to tell if someone is in fact driving because of the activity they are doing. Although I don’t think this would be a reason to pull someone over just for looking at
