the revision of the philippine constitution, which was approved on march 22, 1991, was the result of the significant legal reform efforts of the supreme court since the 1987 philippine constitution. the supreme court made three major reforms. first, the supreme court removed the provisions of the 1987 philippine constitution that were inconsistent with existing philippine laws. in this regard, the supreme court brought the legal doctrine of implied repeal down to its literal level, saying that where there is an irreconcilable conflict between a provision of the 1987 philippine constitution and a provision of an existing law, the former prevails.

second, the supreme court modified the 1987 philippine constitution to bring it in conformity with the philippine constitution of 1973. the supreme court had to address all of the constitutional amendments proposed by the 1973 philippine constitution. however, only the proposed amendments of the 1987 philippine constitution were considered.

third, the supreme court made the 1987 philippine constitution compatible with the existing legal system. the supreme court ruled that article 9, consequences of failure of the congress to meet its mandate was a provision in derogation of the basic structure of the 1987 philippine constitution and therefore unconstitutional. to ensure that the 1987 philippine constitution can be implemented, the supreme court made the following important rulings:

to be more specific, in 2010, the commission on elections (comelec) and the supreme court of the philippines (sc) issued a joint rule on the procedure for the convening of the constitutional convention (con-com).
there is a good reason why a con-com should be organized to draft the constitution. if the con-com fails to do so, the next step is for the comelec to convene a constitutional assembly (con-ass). a con-ass is to have a similar format of the con-com except that it shall consist of only one member from the three branches of government.
