It was the culmination of years of Kafkaesque meticulousness – a request for telecom access, the April argument over what to do with the data they had gleaned, and a simple conversation between James Clapper, the nation’s top intelligence chief, and Obama, in July 2012, concerning ‘a major terrorist threat.’ And in that one conversation, the intelligence community had, for the second time in two years, hampered a presidential administration in doing what it needed to do to protect the American people.

Soon after that video exchange, between Obama and Clapper, a series of internal NSA deliberations would claim the lives of the first American killed in the ongoing spy and terrorist hunt – a French convert to Islam, Ahmed Belbacha, and an Argentinian-American, David Hartley. To understand how that happened, and why, is to understand the crisis in America’s counter-terrorist surveillance apparatus – and the disastrous future in store.

It all began in a meeting between America’s top spy, director of the National Security Agency (NSA), and James Clapper, the nation’s most senior intelligence officer at the time. He was there because of Ray Rodriguez’s call. In the early part of 2012, he had been contacted by a colleague at the NSA’s tech outfit, who had spoken to a French convert, a sympathiser of the Paris attacks, who’d tell him there was a group of al-Qaeda sympathisers in New York, in the United States, planning a major terrorist operation.

Clapper’s colleague outlined the possible alert they’d got and said that he’d put it to the NSA director, so he’d better get his trolley and meet the man, in person, at the NSA’s headquarters in Fort Meade, Maryland.

“The intelligence community was not doing a good job in the face of a major terrorist threat, in particular,” Clapper explains in his fourth and final session for the Henry Jackson Society. He has just gone into the public service and retired quietly, without a fuss. Today, with a glass of fine wine in his hand, he expresses himself with joy and certainly no rancour. Two years ago, when speaking in DC and the west’s other capitals, he was scathing about the US administration he served and the people in the US intelligence community.
